Event Description :
Panel Discussion on ‘Reformation of Maintenance Laws'
Vasavya Mahila Mandali (VMM) is an NGO in India that has been working for over 50 years to empower women, children, and youth. VMM is dedicated to promoting women's rights, providing legal aid and support to women seeking maintenance from their spouses, and advocating for policy reforms to ensure gender equality.
In India, women face numerous challenges when seeking maintenance from their spouses, including legal, economic, societal, family, and health-related issues. Despite existing laws, women often struggle to receive maintenance, leading to economic loss for the nation as well. To address these challenges, VMM suggests several solutions, including:
Framing a Maintenance Act that aligns different sections in various laws to bring uniformity and speedy disposal of cases.
Creating a National Registry of domestic abusers/offenders.
Streamlining alimony/interim maintenance/final settlement procedures by passing a one-time settlement order and directing the employer to deduct from the salary of the person liable to pay monthly allowance.
Tapping into retirement funds of the husband working in an organization and implementing attachment orders to provide maintenance money to the wife.
Bringing together existing one-stop centres, domestic violence cells, legal cell authority, and Swadhar homes under one umbrella for better coordination with the police
Creating a well-coordinated Monitoring System to track maintenance cases by the police department at each police unit.
Establishing a fund by the Government of India to support women fighting maintenance cases.
Addressing the challenges faced by women seeking maintenance requires a comprehensive approach that considers legal, economic, societal, family, and health-related issues. By implementing the solutions proposed by VMM, India can promote women's rights, empower women, and ensure that they have access to the resources and opportunities needed to live a life of dignity and independence.
